Sean Fernandes Interviewed by ABA Regarding Protecting Electronic Communication

Ellis & Winters LLP attorney Sean Fernandes was recently interviewed by the ABA Litigation News on his thoughts regarding protecting electronic communication. The article, “ABA Provides Ethical Advice to Protect Electronic Communication,” concerns an opinion issued by the ABA Standing Committee on Ethics and Professional Responsibility.
In the interview, Mr. Fernandes discusses the importance of lawyer’s understanding the technology they use, including different types of encryption and common electronic security measures. He also offers recommendations to lawyers on how to fulfill their ethical obligations relating to cybersecurity, ranging from baseline measures, to the pursuit of an ISO/IEC 27001:2013 certification.

Sean Fernandes is a member of the firm’s Privacy & Data Security and Litigation practice groups. In his Privacy & Data Security practice, Sean has advised clients on compliance with international privacy laws, including GDPR, and state and federal privacy and breach notification laws, including HIPAA, the Fair Credit Reporting Act, the Gramm-Leach-Bliley Act, and state identity theft laws. He is also an active member of the Privacy and Data Security Committee of the ABA’s Litigation Section. In 2017, Sean became certified by the International Association of Privacy Professionals (IAPP) as a Certified Information Privacy Professional/United States (CIPP/US).
