Appellate Practice


Twelve of the firm’s litigators have clerkship experience.  Six Ellis & Winters lawyers clerked for appellate judges, including five for federal appellate judges.  The firm has clerkship experience on the Third, Fourth, and Eighth Circuits. 


The firm takes pride in its leadership within the national and state appellate bar.  Longtime Ellis & Winters partner Matt Sawchak was recently appointed as the Solicitor General of North Carolina.  Stephen Feldman served for three years as a chair of the American Bar Association’s Appellate Practice Committee.  Mr. Feldman is an officer of the North Carolina Bar Association’s Appellate Practice Section.  Paul Sun, Jon Sasser, Tom Segars, and Mr. Feldman have all served as speakers at annual appellate practice CLE programs.  Ellis & Winters attorneys have also served as the chairs of the North Carolina Appellate Rules Committee — the committee that advises the North Carolina Supreme Court on rules of appellate procedure. Ellis & Winters attorneys have devoted hundreds of hours coaching appellate moot court teams and judging appellate moot court competitions.


The firm’s lawyers have litigated well over one hundred appellate matters.  These matters involve not only trial court cases litigated by the firm’s attorneys, but also new appeals in which the firm did not participate in the trial court.  The firm’s appellate lawyers are also sought out to author amicus curiae briefs to aid the appellate courts in their deliberations.
